Agnostic dad appeals child custody decision based on religion

On August 6, 2008, PCDCS filed its pre-dispositional report with the trial court, which indicated under the sub-heading "Parental History" that "paternity has not yet been established for [Father]." (Appellant's App. p. 31). The report later indicated, however, that J.O.'s family formerly "consisted of [J.O.] and his parents. The father is currently in Lake County Jail . . . ." (Appellant's App. p. 33). Nevertheless, Father was not made a party to the CHINS proceedings, he was not offered and/or referred for reunification services, he was not provided with a copy of the pre-dispositional report, and he was never advised that a dispositional hearing had been set for August 19, 2008.

Santa Ana - A panel of California appellate court justices today ruled that a 2-year-old girl at the center of a child custody battle between a south Orange County foster mother and the girl's birth father in Ohio should stay in California as the case is sorted out.

SANTA FE, N.M. (AP) - The state Court of Appeals has ruled the same-sex partner of an adoptive mother can't seek custody of the couple's child but may request visitation.

A divided court decided Wednesday that New Mexico laws provide no legal right for a Santa Fe-area woman to bring a lawsuit asking for custody of the child, who was adopted by her partner during their 15-year relationship.

The court's majority said the state's custody law applies to biological or adoptive parents, and third parties - such as the unmarried partner of an adoptive parent - can't seek child custody unless the parent is unfit.

Judge Michael E. Vigil dissented, saying a partner should be able to seek custody when a parent-child bond has formed.

A recent court order filed on Monday mandates that a Vermont court decision to give custody of 7-year-old girl to one parent of a separated lesbian couple be enforceable in Virginia.

In 2002, Isabella Miller-Jenkins was born to Janet Jenkins and Lisa Miller through artificial insemination in Vermont. In 2003, when the couple split, custody of the child was given to Miller, who then moved to Virginia and renounced homosexuality, the News and Advance reports.

Later that year, Vermont's supreme court granted custody of the child to Jenkins, after it was revealed that Miller had denied visitation rights and had stopped speaking to attorneys.

Monday's court order verifies that the Vermont court decision is enforceable in the Commonwealth of Virginia.

Jenkins' attorney, Rebecca Glenburg of the Virginia American Civil Liberties Union, told the news source, "We expect Virginia law enforcement to take whatever actions they can to locate the child and make sure the custody order is complied with."

Currently, the whereabouts of Miller and the child are unknown.

According to the Center for Children's Justice, a former spouse is most frequently the greatest obstacle for contact with a child in custody cases.

How the tides have turn, now that we are lesbians and Gays as co parents,, it was only a matter of time before one of these folks would be in our shoes (fathers) Now this lady is finding out that mothers do to fathers when they lose in court. I can only wonder how long it will be for they find Ms Miller and her child. Once found I can bet that the child won't be turn over to Ms Jenkins ASAP. There will be more hearings for her in the future.

I can also bet that Ms Miller will claim she ran to protect the child for a sick Lesbian, which she used to be one.. I see a theme here, do you.

If you can't get child support legally then steal it from others

DELHI, N.Y. - Upstate New York prosecutors say a former county child support investigator stole more than $50,000 from a fund containing court-ordered child support payments.

Authorities are charging 50-year-old Karen Faulkner of Trout Creek with second-degree grand larceny, which is punishable by up to 15 years in state prison. She's also charged with 57 felony counts of falsifying business records.

Faulkner allegedly stole the money between October 2003 and October 2007 while working for Delaware County as a support investigator. Prosecutors say no children were deprived of financial support.

Faulkner was released on her own recognizance after being arraigned Delhi Town Court. Prosecutors could not immediately say if she had an attorney.

Pa. counties sued in mistaken child-support case

HARRISBURG, Pa. - A Philadelphia man who was forced to pay child support for another man's daughter and went to jail for falling behind on the payments is suing two Pennsylvania counties.

The lawsuit filed last week by Walter Andre Sharpe Jr. names Dauphin and Montgomery counties.

The suit filed in federal court in Harrisburg says officials changed his personal identifying information in their computer systems to make him appear to be the child's father.

Sharpe is seeking unspecified damages.

Dauphin County District Attorney Ed Marsico says after investigating the matter that he won't file criminal charges.

Sharpe spent more than a year in jail in Dauphin County, where the girl's mother lived, and he was denied reimbursement for the $12,000 he paid for support.

We must make this type of abused known, and that we will not sit back and allow it to keep on happening.

One day (soon) this once great country of ours is going to implode. We already have the highest male incarceration rate in the world. We have a tax base that relies heavily on male workers. We have an institution in place that does everything it can to abstain men from marriage and fatherhood. No more marriages, no more kids (read: male offspring), males continuously thrown in prison for victimless crimes - who's going to be financially supporting this country? Women/Mothers? Children? Politicians? Corporations? Forget Al Qeada. This will be magnitudes worse than anything a group of terrorists from a foreign land could even dream of inflicting on us.

Lawyer penalized for writing child

According to the committee's records, while Werme was representing the father, she wrote a letter to his daughter despite a court order barring Werme, her client or his family from contacting the girl.

The court had issued the no-contact order because previous phone calls between the girl and her father were so upsetting they had exacerbated the girl's unspecified medical condition, according to committee files. In her January 2007 letter to the girl, who was then 16, Werme told the girl her relatives were lying to her when they allegedly told her she would have enough money to attend college if only her father paid his overdue child support.

In the letter, which is part of Werme's Professional Conduct Committee file, Werme told the girl there likely wouldn't be enough money for her even if her father won Megabucks and paid all of his child support.

Werme wrote to the girl that her father could offer only his love.

Child custody case to study constitutional protections

A court hearing is scheduled tomorrow on arguments that allege the basic child custody procedures used by judges in Bradley County, Tenn., are unconstitutionally biased in favor of one parent.

According to Thorne, the case before Circuit Judge J. Michael Sharp is testing the court procedures used in the child custody case of 3-year-old Kate Hopkins, which began in 2007.

After more than two years in court and five different judges, the case is set for trial beginning May 27 in Sharp's courtroom. But Sharp is hearing the constitutional issues before the rest of the case is heard.

Attorney Jeffrey Miller will argue on behalf of fit Tennessee parents and their children, and an attorney from the Tennessee attorney general's office, Warren Jasper, is expected to argue on behalf of the standard procedures.

According to a statement from Thorne, one of the procedures that will be challenged is the "80-day rule" created by local judges. It automatically takes effect as soon as a child custody case is filed, allowing one parent only 80 days a year with the child while the other parent is allowed 285 days – regardless of circumstances.

The rule, Miller argues, discriminates against one parent, violating the principle of equal protection as well as due process, since it is imposed without a hearing.

Counselors lie in court and face charges

The attorney for two Lufkin counselors indicted for lying under oath during a child custody case compared the grand jury charges to a bologna sandwich on Thursday.

"There's an old saying that a district attorney could have a grand jury indict a bologna sandwich," said defense attorney John W. Tunnell. "This case is a bologna sandwich."

Tunnell's clients Mark Sutton and Juanda Morgan, who are married to each other and have a counseling practice together, have both been indicted for aggravated perjury. An Angelina County grand jury handed down two counts of the charges against Sutton and five counts against Morgan.

Angelina County District Attorney Clyde Herrington was not available for comment Thursday, although he usually does not comment on cases that are currently under investigation.

Sutton testified in a child custody case earlier this year that the father of the children involved had raised his voice "in a very loud and harassing manner" during the course of a counseling session, according to an indictment handed down by a grand jury Tuesday. Morgan testified that during her counseling session with the father "he began to yell very loudly at me," the report stated. Sutton and Morgan also said under oath they would characterize the father's type of behavior as consistent with a person who has rage, the report stated.

A tape recording of the session, reviewed and investigated by a Texas Ranger, revealed "such statement as being false," the report stated.

Morgan responded to a request for comment made Wednesday in a phone message left Thursday morning. She said she and her husband would not be avoiding comment on the case.

"This is a story that really affects the entire mental health counseling community here in Lufkin, in my opinion," she said. "Even though it looks like my specific problem at the moment, I think it indicates what a lot of mental health professionals are up against when occasionally a parent expects you to be a hired gun on the stand rather than a mental health professional."

The indictment issued Tuesday is not expected to affect the custody court case, which has already been resolved. The father did get custody rights to the children.

LAWS OF EVE - Application for maintenance of children

In a recent Supreme Court decision (PEC v DRC) which was delivered on April 4, the judge was asked to consider an application by a mother for increased contribution towards maintenance by the father of the couple's eight-year-old child. Three issues were considered by the judge:

1. What amounts to reasonable expense in respect of an eight- year-old child?

Whenever the court considers a maintenance application on behalf of a child, there is an attempt to identify what sums are incurred exclusively for the child's benefit. Therefore, expenses such as rent, mortgage, cost of hiring a helper and utilities are usually apportioned between the child and the other person or persons who share that home with him or her.

In the case of DRC's application, the judge was of the view that an allocation of half of the mortgage and the utilities to an eight-year- old was unreasonable. Instead, the judge concluded that a third or a quarter of those expenses was exclusively incurred for the child's benefit.

2. If an application for maintenance is made pursuant to the Children (Guardianship and Custody) Act, does the court have to consider the applicant's means?

There are alternative statutes under which applications for maintenance may be made. One such statute is the Children (Guardianship and Custody) Act, which speaks only to the examination of the father's means by the court. In some other statutes, such as the Maintenance Act, the court is directed to consider the means of both parents.

In the case of PEC v DRC, the application was made by the mother and her attorney-at-law argued that she did not need to provide information regarding her income, because the court only needed to consider the father's means. However, the court did not find favour with that argument and ruled that both the means of the father and the mother should be considered.

3. If an application for maintenance is made pursuant to the Children (Guardianship and Custody) Act, can the court have regard to the provisions of the Maintenance Act?

The judge was of the view that because the court was concerned to ensure the best interests of the child, he was not constrained to confine his considerations to the statute under which the application was made. He stated that, "the court should not be hampered by procedural trappings, but should approach its task with practicality". Therefore, the judge ruled that the principles outlined in the Maintenance Act, which indicate that there is equal obligation for parents to maintain a child, remained applicable.

Lasalle, Illinois -- What happens after your only son dies suddenly? One father finds out that not only is he cut out of the obituary, but also on the death certificate.

In Lasalle, Illinois, George Harmon is grieving the loss of his only son., Kristopher. Kristopher Harmon died from an accidental gunshot wound while cleaning his gun on Friday, August 22 in his home in Council Bluff, Iowa.

Harmon received a call around 8:30 p.m that night from his daughter-in-law Ginger Harmon. "I was devastated, when she called I kept thinking that it was a joke. It could not have happened to my son." states Harmon. The following day was a blur, Harmon made calls to his family and kept in touch with Kristopher's widow, in order to have information on what happened and what the services were going to be. "Everything was a blur, I was numb, I just wanted it all to be a mistake."

Sunday brought more grief, when Harmon received one final call from Ginger regarding the obituary that was published in the August 24th Council Bluffs Non Pariel newspaper. "The call was to warn me that I was not mentioned in the obit, I was never mentioned as the father. Another man was." Apparently a man by the name of Keith Hadfield of Omaha, Nebraska was mentioned as the surviving father.

Upon finding this out and trying to contact the paper to no avail, he contacted the Cuttler-O'Neill-Meyer-Woodring Funeral Home also located in Council Bluffs, Iowa to find out who had wrote the obituary. "I was directed to the director, and he stated that he had wrote the obituary at the request of Kristopher Harmon's wife and mother Renee Lewis. The director was very apologetic but had stated that he can not change the information per that request, and that it did concern him that Keith Hadfield was named Kristopher's father on the death certificate."

Now it would seem that fathers don't have the right to mention in their kids Obituary all at the request of the mother. Where will this injustice end.

Decent fathers are left powerless to see their estranged children if vengeful mothers are determined to prevent access, a senior judge has admitted.

Lord Justice Ward attacked child access law after presiding over a case that saw a “vicious” mother falsely accuse her ex-husband of sexually abusing their child.

He spoke out after telling the father that there was nothing he could do to help him re-establish contact with his daughter after his ex-wife turned her against him.

The man’s 14-year-old daughter, who cannot been identified, had been influenced by a “drip, drip, drip of venom” from his ex-wife, who wanted to deny him his paternal rights.

Lord Justice Ward said the case was bordering on the scandalous but the court was compelled to act in the interests of the child.

Because of her mother’s “viciously corrupting” influence, it would cause the teenager too much distress if she spent time with her father, he said.

In London’s Civil Appeal Court, Lord Justice Ward said: “The father complains bitterly, passionately, and with every justification, that the law is sterile, impotent and utterly useless.

”But the question is 'what can this court do?’ The answer is nothing.”

The parents were briefly married in the 1990s and their daughter was a baby when they parted.

Lord Justice Ward said it was “impossible” that the girl could remember being abused and it was obvious it was something she had been told and believed.

In 1997 a judge ruled that allegations of sexual abuse were “wholly unfounded”.

The malignant influence of the mother, who lives in the Lincoln area, came to a head when the girl wrote to her father when she was nine.

The letter read: “This is what I really think about you. I hate you and you frighten me. You made my life miserable and stressful. I wish you would die. Leave me alone.”

In 2004 the father went to Lincoln County Court in an attempt to gain access. He was allowed to see her, but only under the supervision of a priest.

The contact was an unhappy experience for the daughter and the arrangement ceased. At a later court hearing, the father virtually admitted that further meetings would distress her.

At the Court of Appeal, Lord Justice Ward refused the father permission to appeal his decision. The father is considering taking a case to the European Court of Human Rights.

Gay sperm donor denied son access

Civil liberties groups demanded radical reform of family law after a gay man, who donated sperm to a lesbian couple, was refused rights to his biological son.

Dublin's High Court ruled that the man, who had been friends with the women, should have no guardianship or access to the child and the toddler would be better off with the couple. The landmark ruling is the latest case to expose serious gaps in family law, fathers' rights and a lack of legislation on same-sex couples.

The Unmarried and Separated Fathers of Ireland warned the decision could end up being a major setback for fathers' rights. Legal spokesman Donnacha Murphy said: "Legislation may further the issue of inequality in Irish family life. The only way to achieve ultimate equality is by an amendment to the constitution."

Today was Daddy's Day at school, and she couldn't wait to go.
But her mommy tried to tell her, that she probably should stay home.
Why the kids might not understand, if she went to school alone.
But she was not afraid; she knew just what to say.
What to tell her classmates of why he wasn't there today.
But still her mother worried, for her to face this day alone.
And that was why once again, she tried to keep her daughter home.
But the little girl went to school, eager to tell them all.
About a dad she never sees a dad who never calls.
There were daddies along the wall in back, for everyone to meet.
Children squirming impatiently, anxious in their seats.
One by one the teacher called, a student from the class.
To introduce their daddy, as seconds slowly passed.
At last the teacher called her name, every child turned to stare.
Each of them was searching, for a man who wasn't there.
"Where's her daddy at?" she heard a boy call out.
"She probably doesn't have one," another student dared to shout.
And from somewhere near the back, she heard a daddy say,
"Looks like another deadbeat dad, too busy to waste his day."
The words did not offend her, as she smiled up at her Mom.
And looked back at her teacher, who told her to go on.
And with hands behind her back, slowly she began to speak.
And out from the mouth of a child, came words incredibly unique.
"My Daddy couldn't be here, because he lives so far away.
But I know he wishes he could be, since this is such a special day.
And though you cannot meet him, I wanted you to know.
All about my daddy, and how much he loves me so.
He loved to tell me stories he taught me to ride my bike.
He surprised me with pink roses, and taught me to fly a kite.
We used to share fudge sundaes, and ice cream in a cone.
And though you cannot see him, I'm not standing here alone.
"Cause my daddy's always with me, even though we are apart
I know because he told me, he'll forever be in my heart"
With that, her little hand reached up, and lay across her chest.
Feeling her own heartbeat, beneath her favorite dress.
And from somewhere in the crowd of dads, mother stood in tears.
Proudly watching her daughter, who was wise beyond her years.
For she stood up for the love of a man not in her life.
Doing what was best for her, doing what was right.
And when she dropped her hand back down, staring straight into the crowd.
She finished with a voice so soft, but its message clear and loud.

When airplanes hit the towers and taught Americans to fear.
But sometimes when I close my eyes, it's like he never went away."

Who knows what they saw before them, who knows what they felt inside.
Perhaps for merely a second, they saw him at her side.

And what happened next made believers, of those once filled with doubt.
Not one in that room could explain it, for each of their eyes had been closed.

I read an article titled "Women in New York prisons seek better child custody protections," but the article left me with more questions than answers.

Why are these advocates more concerned about women in prison than the children they leave behind? Children normally have a mother and a father. Shouldn't these advocates be trying to ensure that a decent loving dad should have a chance at raising the child instead of a criminal mother?

Serena Alfieri, Women in Prison project coordinator, said when mothers get to interact with their children in prison it provides an incentive for rehabilitation and decreases the chance for recidivism upon release. This is true -- but there are far more fathers in prison than mothers. Wouldn't the same hold true for the imprisoned dad?

Most people in prison, men and women, were raised in a home without a father present. With statistics like this, wouldn't it be more important to connect children with their dads?

A landmark child custody ruling has left a Czech mother relieved to be allowed to keep her son in the country, and an American father planning an appeal to have the child returned to him in the United States.

On Feb. 25, Prague 5 District Court decided that Czech citizen Veronika Horváthová, who had kidnapped her 4-year-old son Adrian from his father, California resident Pablo Santana, would be given full custody. This is the first time in Czech history that the Child Abduction Section of the Hague Convention has been used to grant custody to a parent who has kidnapped a child.

Parental Alienation Syndrome is by far the most controversial theory in high-conflict child custody litigation. And the battle lines are drawn primarily by gender: PAS is apt to be the first line of defense when a husband is accused in a custody battle of sexually abusing his children. That is, provided he has the money to hire a high-powered attorney.

PAS in any form is wrong. It does exist no matter that its not accept by APA. I still feel that we should leave off the word Syndrome, and replace it with the word action. 11. The children may be the only aspect of control the mother has, so uses it to boost her own esteem rather than for the interests of the children. This is the power motive more commonly seen in men.
12. The mother may still like the father and uses the children as a means of controlling him.
13. The mother may be punishing the fathers new partner indirectly as the father may know that he could see the children if it wasn’t for the new partner.
14. The mother may be independent and never wanted a man around anyway apart from fathering her children (entrapment). Or she may have gained independence during the marriage and now wants to exploit it.
15. As often quoted, the mother may see children as a way of getting a house, welfare money, and other benefits. The father was always incidental in the matter.
16. Some women actually believe that men are not interested in their children.
17. The mother assumes hostility by the father towards her is also towards the children, so ‘protects’ them by keeping him away.
18. The mother has a different lifestyle to the father, and does not want the children to copy his way of life.
19. The mother may have no family of her own (typically foreign wives), whereas the father may have a family. The mother regards the child as ‘her family’.
20. The mother may become emotionally dependent upon the child, and regard any affections the child has for the father as depriving her.
21. The mother simply regards the child as her property, and sees the father as making a claim on her ‘possessions’.
22. The mother dislikes the fathers new partner, who she sees as a rival ‘mother’, so prevents the child seeing the father.
23. The mother’s new partner is the one who is preventing contact because he wishes to be seen as the ‘daddy’.
24. She fears the children will leave her for him.
25. She wants to prove to her new partner that he is the only man in her life.
26. She may have come from a broken family, and not be able to sustain a relationship.
27. The father is a constant reminder of the failed relationship that she prefers to forget.

State's Mistake Denies Father Rights To His Child

In April 2006, Eggleston got a surprising letter from the Foster Care Review Board saying his child's mother had attempted suicide the previous summer and the child had been made a ward of the state.

"They told me that she had been in foster care with her grandmother for almost a year. Wow. I had no clue, and by that time -- well, they knew where I was to take my money, but how come no one ever notified me?" Eggleston said.

Attorney Amy Geren now represents Eggleston. She said that because the state dropped the ball, Eggleston missed out on an opportunity to gain custody of his child. He is suing the state.

"They knew exactly where to find him. They just didn't make any attempt to notify him. If the custodial mother is not able to care for that child, the first choice should be to place that child with the non-custodial parent," Geren said.

This is Nebraska's first test case for a new law that allows state officials to give more than just a "no comment" on child abuse and neglect cases. LB 782, just signed within the last couple weeks, allows Landry to release information about children who are state wards.

Custody statute is bad math

William Farrell is a stand-up guy who works hard to provide for his two kids.

But the Longmont resident says a revision to Colorado's child-custody statute is forcing him and thousands of others to work even harder.

The statute in question is 14-10-115. It allows children born after a divorce to be factored into child-support payments. It increases payments when the custodial parent has another child. But it can also lessen benefits for kids when the noncustodial parent has another child.

"It bothers me extremely," Farrell said. "Without using four - letter words, it's really unfair to have to support a child born years after the divorce."

Farrell has primary custody of the two daughters, ages 5 and 7, he had with his ex-wife. She gets the kids every other weekend.

Farrell said his ex-wife, who could not be reached for comment, has four kids by three fathers. Her last child was born in June.

Before the revised law took effect Jan. 1, you were only responsible for the children you brought into this world.

Finally a court rule in favor of non-bio father to rise his ex-wife child.

A Utah man is the legal father of a boy he raised as his own, even though his wife conceived the child through an extramarital affair, the Utah Supreme Court ruled Tuesday.

As part of divorce proceedings initiated when the boy was about 16 months old, a 3rd District judge ruled that the other man was the "natural, biological, and legal father" of the child. He gave this man and the mother, who married after her divorce was finalized, joint legal custody and primary physical custody of the boy.

The ex-husband was granted "joint physical custody time," which resulted in the boy spending about half his time living with him. He appealed, saying he should be recognized as the child's father and also have legal custody.

In a 4-to-1 decision, the high court upheld a 2006 Court of Appeals ruling that held the former husband is the legal father. The Supreme Court based its ruling on an analysis it developed in a 1990 case on whether the presumption that a husband is the father of a child born to his wife during their marriage can be challenged.

Because the marriage of the mother and her husband was intact when the boy was born in 1999 and the husband - who knew the child was not his biological son - voluntarily assumed parental responsibility, "the presumption of [his] paternity cannot be challenged in this case," the Supreme Court majority said Chief Justice .

Christine Durham dissented, saying the case should not be decided by the 1990 analysis. Rather, she argued, a decision on the right to challenge the husband's paternity should be based on more recent statutory changes in family law.

Ra'anana, Israel ---- March 16....(INA) - Fathers and children rights custody groups in Israel protesting gender bias discrimination in court custody cases have intensified their public demonstrations.

Last week hundreds of divorced and single fathers met in Tel Aviv to demand joint and or equal custody in a non-violent protest covered by both Israel TV and several local newspapers. The fathers are demanding that the Israel Knesset, Israel family court judges and Israel child welfare departments adopt reforms in the existing Israel Family Custodian Act of 1962 which states that all children under the age of six will automatically have custody under their mother, unless the mother is violent, drug abuser or negligent.

Don't leave fathers out of custody cases

DIVORCED FATHERS and their children deserve a better deal than they're getting from the courts. A shared parenting bill in the state House would create a "rebuttable presumption" - that as long as both parents are fit and it is practical, both parents are entitled to equal custody of the children. Currently, custody almost always goes solely to the mother when she objects to shared parenting.

A "rebuttable presumption" is an easy concept.

The court starts with the common sense position that it is usually in the best interest of children that they be raised equally by both parents after separation. As much as is reasonably practical, the court allows the children to spend equal time with both their mothers and fathers. It is a "rebuttable" presumption because the other parent could introduce evidence that a parent is unsuitable, or that as a practical matter it would be logistically unworkable, and that they have not done anything improper to make it unworkable.

The chief focus in child custody cases would continue to be on what is best for the child and nothing would be "automatic." A judge would still examine every individual case to make sure the child's needs are being met. In fact, "rebuttable presumptions" are nothing new in child custody cases.

Since 1999 we have had a "rebuttable presumption" that seriously violent parents should not be awarded custody of their children. None of the silly parade of horribles of judges with their hands tied automatically dispensing custody decrees without examining the facts of each individual case, resulted.

Currently, Massachusetts statutory law does not presume that there should or should not be joint physical custody. But there's a big difference between the law and reality. In courtrooms across the state, when a mother objects to joint physical custody, she essentially extinguishes the hope of the father, even when sharing custody seems eminently workable and in the children's best interest. A study by Joseph McNabb of Laboure College found that mothers obtained sole physical custody 83.2 percent of the time, fathers obtained sole custody 8.8 percent of the time, and joint custody was only awarded 8 percent of the time.

That's a devastating number for fathers who want to be meaningful parts of their children's lives. Many fathers justifiably feel as if their children have been the victims of state-sponsored kidnapping, punished for committing the unpardonable sin of being the primary breadwinner. Though opponents claim that more research is necessary, the effects of fatherlessness have been abundantly studied.

According to divorcemag.com, fatherless homes account for 63 percent of youth suicides, 90 percent of homeless/runaway children, 85 percent of children with behavior problems, 71 percent of high school dropouts, 85 percent of youths in prison, and more than 50 percent of teen mothers. Dr. Robert Bauserman did a meta-analysis (a study of all the studies) of 33 studies between 1982 to 1999 published by the American Psychological Association. In total, 1,846 sole-custody and 814 joint-custody children were studied. He concluded that "Children in joint custody arrangements had less behavioral and emotional problems, had higher self-esteem, better family relations and school performance than children in sole custody arrangements."

Most people don't need research to convince them of the obvious overwhelming benefits of fathers. They already know. That's why shared parenting won 87 percent of the support of Massachusetts voters when it was a non-binding ballot question in 2004.

Shared parenting reduces litigation as parties do not have to continually go to court in the never-ending battle to prove that they are the better parent and deserve sole custody of the child.

Equality, mutual respect, ending conflict and endless litigation and providing children both of their parents - values not fostered by the current system - would not only benefit the parents, but it would be of incalculable value to the children. That's why we need shared parenting.

NEWS- Sex abuse: Another dad sues Social Services

According to many sexual abuse experts, mothers of young children almost never lodge false accusations of sexual abuse against the father of their children.

"Almost never" are the operative words, according to two Virginia fathers who allege that four Albemarle County Social Services social workers and a Newport News therapist joined with the mothers of their daughters in relentless and baseless persecution of them even after courtroom evidence emerged to prove their innocence.

The first father, a Nelson County man using the pseudonym John T. Nelson in court documents to protect his daughter's identity, filed a $4 million suit in December 2006, as detailed in a June 14, 2007 Hook news story ["Social dis-services? Dad sues for $4 mil over alleged molestation."]

The second suit, filed in August 2007 and which the Hook recently discovered, names the same five defendants and outlines similar allegations. That father, a Spotsylvania County man known as John Proctor in court documents, asks for $7 million to compensate him and his six-year-old daughter for the anguish of enduring "the most unspeakable and disgusting false allegations" and "wholly improper government intrusion."

Proctor's attorney, Fredericksburg-based Leila Kilgore, says she and her client learned about Nelson's case after reading the Hook's article as they prepared to file their case in federal court.

"We were stunned," says Kilgore. "There was some relief for my client that he wasn't alone. It bolstered his feeling that he had to do something."

Of note, says Kilgore, are the parallels between the cases. Both Proctor and Nelson were engaged in protracted custody battles over their preschool-aged daughters when the girls' mothers accused the men of sexual abuse, and an investigation by Albemarle County Social Services began. (While Nelson's child resides in Albemarle County, Proctor's case was assigned to Albemarle County Social Services-- illegally, Proctor's suit alleges.)

Nelson's attorney, Kirk Schroder, declines comment on the case citing a gag order, except to say, "The pleadings speak for themselves."

The mother of Nelson's daughter, called "Cathy Rio" in the suit, says she can't talk specifically about what Nelson stands accused of because of an ongoing custody battle currently being appealed. Those papers are sealed, and all involved parties are under a gag order, says Rio. But she strongly disputes the notion that the investigation and ensuing custody battle were baseless.

Though neither the Nelson nor Proctor cases contain lurid details of the alleged abuse, in both cases, after investigating, Social Services lodged a "Level one founded" disposition-- the most serious-- in the central registry of sex offenders located in Richmond. In both cases, however, those founded dispositions were overturned following review by the central office.

Also in both cases, Albemarle County's investigator, Lori Green, sent the girls 100 miles away to Newport News for a forensic interview by therapist Viola Vaughan-Eden, rather than having them interviewed by local therapists. Both Nelson and Proctor allege Vaughan-Eden's involvement in their cases was inappropriate, with Proctor calling Vaughan-Eden a "professional license for hire."

The plaintiffs both allege that Vaughan-Eden lacks the forensic training to perform such an interview, and in each case, the men allege, she failed to audiotape the girls' statements, which the suits claim is standard protocol to protect both the accused parent and the child.

According to Nelson's suit, Green allowed the mother of his daughter to furnish Vaughan-Eden with information Green knew to be "false and prejudicial." The suit alleges Green gave the mother 24-hours notice of the forensic interview, providing time, the suit alleges, for the mother to coach the child to make allegations. Proctor also alleges that Vaughan-Eden, a board member-at-large of the American Professional Society on Abuse of Children, ignored evidence of "coaching" by his daughter's mother, even after it had been noted and entered into evidence during hearings in state court.

Kathy Ralston, director of Albemarle County Social Services and a defendant in each case, referred all inquiries about the cases to county-appointed attorney Richard Milnor. Milnor, who also represents Social Service employees Lori Green, Cindy Casey, and John Freeman, did not return the Hook's repeated calls, nor did Vaughan-Eden.

Though the defense isn't talking, their counter-filings suggest they will mount a vigorous defense. In their response to the complaints, the defendants deny all allegations. Each of the social services employees has also filed motions to dismiss, citing the immunity provided by their government positions.

Claire Kaplan, director of Sexual and Domestic Violence Services at UVA, says the notion that vindictive mothers drive such accusations is unfounded. Indeed, various studies estimate the rate of false allegations is small-- ranging from 2-8 percent. The National District Attorney's Association estimates that one in five children are victims of sexual abuse, most of them at the hands of someone they know and trust.

Kaplan further says mothers who believe their children have been sexually abused have an uphill battle to fight in court, particularly because it's so difficult to prove the allegations. Defense attorneys often claim mothers are making false accusations by vilifying them as angry, hostile, hysterical. Anger, says Kaplan, doesn't prove an allegation is false.

"Wouldn't you be angry if your child was being sexually abused?" she asks.

Trial dates have not yet been set in Nelson's and Proctor's cases.

Ex-spouses may see faster enforcement of child-visitation rights

A pilot program that is speeding up the enforcement process when a divorced parent violates a court-ordered child time for an ex-spouse was given top priority status and unanimously endorsed by a legislative budget subcommittee Wednesday.

Similar legislation to HB22 was given the same status a year ago but was ultimately voted down in the House.

Those and other concerns raised last year have been addressed in the current bill, the proposal's sponsor, Rep. Julie Fisher, R-Fruit Heights, told members of the Legislature's criminal justice appropriations subcommittee.

HB22 doesn't override the section of the law dealing with steps a divorced parent must follow when an ex-spouse violates parent-time schedules remains in place. It offers a stopgap measure to the process, which has been criticized for years by fathers' rights groups who say designated and scheduled time with their children can be suddenly changed.

"And nothing happens, not in reality," a father from Boulder, Colo., told the Deseret Morning News after his Thanksgiving time with his two children in Layton was denied by his ex-wife.

"I got out of the car and she came to the driveway and said she had made other plans and wouldn't change them," he said. "The visit was scheduled, she knew I was on my way. She just turned and walked back into the house."

Possible abuse is nearly always the implied reason for a sudden refusal of a visit by a noncustodial father, advocates for the legislation in Utah said. The fact is, the only recourse is to seek court action until weeks and months after an incident.

"Besides, what good is it going to do to service a court order on someone who is violating a court order already?" he said. The state relentlessly demonizes dads who don't pay child support but hardly does a thing when a visit is canceled.

"That's a loud and clear message: money is more important than time with a parent," he said.

The state child support collections section is relentless for back child support, but they virtually never enforce missed child time because an incident is over so fast and fathers who try to make up the time rarely get it back anyway, advocates say.

That's what the bill is designed to do, Fisher said, noting that was the motivation behind the original bill passed last year.

The pilot program that has been under way in 3rd District Court involves going back to court, but a judge can call for the immediate involvement of a mediator to settle a time dispute.

The Family Court of Fall River, like thousands of others, seems to not only sanction, but ardently promote the estrangement of child and father. Further, the mothers, along with their lawyers, manipulate the court with the outdated "every woman is a victim" syndrome and false or exaggerated accusations, and offer up the children as catalysts to punish and impoverish the father.

This is scathingly evident in the case of unwed parents. The fathers of illegitimate children are "fathers" only in the eyes of the bank! Nowhere is this more apparent than a case in California of the unwed mother placing her child up for adoption, the father of the child petitioning the court for custody of his child, and the "wisdom" of the court denying his petition. This particular case is now pending in the Supreme Court. For most, the expense of such a pursuit of justice is completely prohibitive.

Signing an acknowledgement of paternity provides no parental rights to the father. The child, with the blessings of the court, becomes no more than a commodity for the unwed mother. Affording her the lifelong "right" and ability to abuse and harrass the system, the courts and the father of the child without repercussion or accountability. The family courts are overflowing daily with charges that are ludicrous, unfounded and out-and-out lies. Fathers by the droves are brought to task by vindictive, self-serving, deceitful mothers, many of whom practice irresponsible breeding as a means of income.

Yes, there are "dead beat" dads. Many simply choose to ignore their parental responsibilities. But, the majority are "created" by our (in)justice system.

Judgements in Family Court are hawked as in the best interest of the child, when, in fact, they are in the best interest of the court. The family lawyers are much like morticians, preying upon clients at a most vulnerable moment, a time when rationale is set aside. After all, what father is not willing to sacrifice all for his child? Ergo, thousands upon thousands of dollars are mindlessly placed in the hands of attorneys, who, with minimal exception, concern themselves with plans for their next boat purchase and wouldn’t know the best interest of the child if they fell over it.

What about the guardians ad litem? Case in point. After meeting with a "father" who provided extensive legal documentation regarding his child being subjected to frequent visits by an ex-con pedophile and a known heroin addict, the GAL met with the (un-wed) mother. She admitted that both were a part of the small child’s life on a regular basis, and that, "if it matters, I won’t let him go around them anymore." If?

The final recommendation of the GAL was the child should continue to live with the mother, even though there was concern about his safety and well-being (paraphrased). Guardians ad litem have no particular qualifications, if any, and yet the court utilizes and respects their recommendations. Again, where does the "best interest of the child" come into play? Perhaps in the next battle in the court? I doubt it!

Being a father, wed or unwed, is not a crime, except in the Family Court system. Being an unwed mother has lost its stigma, and rightfully so. It happens. If there is a "crime" involved, it is that the Family Court system violates rather than endorses the "best interests of the children."

Until we correct this mockery of jurisprudence, hundreds of thousands of fathers will continue to be estranged or incarcerated, hundreds of thousands of the vindictive mothers will continue to view their children as cash registers and hundreds of thousands of children will fall to abuse and neglect, or worse.

For the many mothers and fathers who work toward the "best interest of the child," blessed be. For the rest of you, bless the children; they deserve better. I hope you get what you deserve!

If I was 14 weeks' pregnant, I could have an abortion. I could simply decide on my own that another child would complicate my life in unacceptable ways. Too expensive, too inconvenient, not the right time - whatever the cause - I could make a call, schedule an abortion and be rid of my problem.

I could do this because I'm a woman, the potential mother-to-be. Fathers, however, do not share the same rights. Just ask Manishkumar Patel.

Patel, 34, of Appleton was charged in November with attempted first-degree intentional homicide of an unborn child and eight other counts for allegedly slipping the abortion drug RU-486 into his pregnant girlfriend's drink. She later miscarried - her second miscarriage in less than a year. (A warrant has been issued for Patel's arrest after he failed to check in with Outagamie County sheriff's authorities last week.)

Patel's actions, if proved, were wrong. No one ever should surreptitiously give a drug to another. But why can a father be charged with attempted homicide when a mother can choose legally to take the exact same drug with the exact same effect.

The legal answer is because Wisconsin is one of 37 states to have a fetal homicide law. In Wisconsin, it is a felony to intentionally destroy the life of an unborn quick child. Under the law, feticide is a Class E felony, carrying a penalty of up to 15 years in prison and fines up to $50,000.

Yet under Roe vs. Wade, women are free to destroy their unborn child at almost any time. Is this fair? Is this right?

Even if you agree with the legality of abortion - which I do - how do you reconcile the fact that mothers-to-be are allowed to stop a pregnancy from progressing to birth while fathers are not? Does the fetus not share the DNA of both mother and father?

Fathers, I think, get short shrift. Because a mother carries the child, she has all the power. She can decide to keep the child or not. The father has no say, although the decision has lifelong implications for both of them. Should the mother decide to keep the child despite the father's wishes, he will be forced to provide financial support for 18 years, whether or not it is convenient to do so. Should she decide to abort a child that he would rather keep, he has no recourse - only empty arms and an empty heart.

It appears Patel had no intention of loving or caring for his unborn child. He was married to another woman. If he and his girlfriend had talked about it, perhaps they could have prevented the unplanned pregnancy, much less two of them. Instead, Patel allegedly took matters into his own hands.

His case deserves our attention. Patel's alleged actions may have been reprehensible, but fathers are parents, too. Let's hope this case draws attention to the rights of fathers everywhere.

Court orders mother to return daughter to her father in Malta

A court has ordered that a three-year-old girl be returned to Malta after ruling that her foreign mother had acted illegally when she took her abroad without informing the Maltese father.

The father had filed an application in the Family Court explaining that over the past four years he had a relationship with a foreign woman and they had a daughter. His daughter was born in Malta and even attended a play school here. Recently, the relationship deteriorated and he left home to live on his boat.

He would go to see his daughter everyday but on October 20 he did not find the girl and her mother at home, he said. After filing a police report he learn that the mother had left the island with his daughter. When he contacted the mother, she told him he would not see his child again if he did not pay her Lm300 a month, the fatherclaimed. Since then he called his daughter everyday on a mobile phone but still did not know where she was.

The mother took his daughter away from Malta without informing him and that, he argued, was illegal according to the Convention on the Civil Aspects of International Child Abduction and the Child Abduction and Custody Act, among others.

He called on the court to declare that the mother had acted illegally, declare Malta as the child's habitual country of residence, grant him exclusive custody over the child and take measures to ensure the child was returned to Malta.

After hearing the case, Mr Justice Joseph Azzopardi ruled that it was clear that the mother took the minor out of Malta without the father's permission and had acted illegally. He decided in favour of the father and agreed to all his requests.

Standing tall in court

A noncustodial father in court, many times maybe: slandered, degraded, lied on, insulted, shamed, disgraced, and dishonored. The whole of his person (his body, mind, will, emotions, and spirits) many times are under constant attack. This may not occur in just one court appearance alone. Many noncustodial fathers may have to appear before a judge several times concerning visitation, child support, and child custody.

How should a noncustodial father carry himself under such strain and stress? My advice is hold your head up high. Don't let what they say (whoever they are: judge, ex, ex's witness, or your children) down press you. Don't fear. Don't stress out. Don't have a nervous breakdown. Don't get into a verbal dispute with your ex or her allies.

You may feel angry about the whole process, but continually carry yourself as a man of integrity. Even if the judge doesn't acknowledge your efforts, god will.

Fathers need bigger role in children's lives

Two children have recently lost their lives, allegedly at the hands
of their mothers. I can only imagine the physical and emotional abuse
these children suffered at the hands of the person today's society
claims is the only person who will nurture and care for them.

What
of other similar cases? Who have those abusers been? Mothers, the
mother's boyfriend, family friends, babysitters. Only in rare cases is
it the father.

Yet, a father brought in to family court simply
accused of any form of abuse by a mother loses his parental rights.
Physical abuse is not the only form. Parental alienation, where a child
is brain washed to believe a non-custodial parent is evil, is abuse,
too.

It's time to bring fathers back to the roles they have
historically held: protector of families and children. Gender does not

Reversing Alienation

It is almost
impossible to know if a child has truly been victimized by parental
alienation syndrome (PAS). There is no test for it, no X-ray can be
examined and lengthy psychological evaluations have a certain amount of
subjectivity regardless of the clinician's efforts to be impartial.

Assuming a parent is able to convince the court his or her child has
been manipulated into hating him or her, then what? If the child is 15,
16 or 17 years old, the chances of reversing the alienation are not
great. Just hearing from a court-appointed psychologist that alienation
has occurred would not take away the child's anger, mistrust and
apprehension.

If the alienated parent is successful in educating the court that he
or she has been unfairly separated from a child, he or she then faces
the choice of either leaving the child with the parent responsible for
the alienation or risking further estrangement by forcing the child to

Judges and the Development of Parental Alienation Syndrome

As I defined it in "False Domestic Violence Accusations Can Lead To Parental Alienation Syndrome," "Parental Alienation Syndrome (PAS) is a pattern of thoughts and behavior that can develop in a child of separated parents where the custodial parent causes the child, through manipulation and access blocking, to unjustifiably fear and/or hate the other parent. PAS is more than brainwashing, in that the child comes to actively participate in the degradation of the target parent, coming up with original (often ludicrous) reasons to fear/hate him or her." Dr. Richard A. Gardner (1931-2003), who coined the term "Parental Alienation Syndrome" in 1985, believed that family court judges, rather than impede the development of PAS, often facilitate it. In two important articles written near the end of his life, "Should Courts Order PAS Children to Visit/Reside with the Alienated Parent?: A Follow-up Study" (2001) and "The Judiciary's Role in the Etiology, Symptom Development, and Treatment of the Parental Alienation Syndrome (PAS)" (2002), Gardner drew on his many years of experience with custody litigation to point out, by my count, five problems with the current system.

According to Gardner, one way judges facilitate the development of PAS is through their undue delay in resolving custody disputes. "I have not once seen a speedy trial in the context of a child-custody dispute. I have seen speedy issuance of restraining orders, often without proper collection of evidence.... But I have never seen a speedy decision made in a child-custody dispute. The usual duration of such cases that have come to my attention has been two to three years between the time of the initiation of the dispute and the time of the court's decision. By that time, the children are significantly older and the decision is made on the basis of data that may no longer be relevant. All this works for the alienator, because the more time the alienator has access to the children, the more deeply entrenched will become the PAS campaign of denigration. By the time the children do come to the attention of the court, they will protest vigorously any kind of a court-imposed program that might lead to reconciliation with the alienated parent."

I have written frequently about parental alienation syndrome, a term used primarily in child-custody cases. Parental alienation syndrome (PAS) happens when one parent alienates or brainwashes a child against the other parent.

Therapists realize PAS may be present when the child has no ambivalence, no discomfort at all vilifying or demonizing the parent he or she has been taught to hate. The child will say things like, "My parent is always selfish, only cares about themselves, never even tries to be fair to the 'good' parent."

A child who is truly victimized by PAS has no problem being abusive toward the hated parent and often cites petty or even manufactured reasons to justify cruelty toward this parent. A boy or girl who has a parent who is truly abusive or neglectful may also feel anger and desire little or no contact, but their emotions are all over the place; riddled with longing, sadness, guilt and not usually punctuated by a pervasive desire to protect the good parent.

Most kids want to love both their parents. But when a child has been taught to hate one, the words the child uses to describe the vilified parent often show this.

Kids who have been brainwashed may use lots of profanity, simplicity and cruelty in the way they describe the parent they believe to be "all bad."

It's one of the ways therapists attempt to identify if parental alienation syndrome has taken place or if the child is justified in not wanting contact with the parent he or she professes to hate. I have counseled hundreds of parents who claim PAS, but really they are just abusive, neglectful or self-absorbed parents. Since PAS is not yet a recognized disorder, a clever parent with an even smarter lawyer may shout PAS when the kids want little to do with them. This could be to avoid paying child support or simply to wreak vengeance on the ex.

It takes a lot of time and patience to sift through all the accusations and counteraccusations to ferret out whether a child is wise to avoid the parent or has been indoctrinated to hate and fear this parent. Sometimes kids hate their parents for all the right reasons. But when a child is brought into my office proclaiming to totally hate one parent and sees nothing but good about the other, my radar goes up.

Often I'll see judges temporarily award custody to the parent the childprefers until sufficient counseling can occur. But unless the counseling also involves the alienated parent, any report the counselor may write is likely to be biased and probably useless. Any counseling potentially involving PAS should be done by a therapist familiar with the dynamics and not easily taken in by one side.

New twist in parents' battle for toddler

One small child, two abductions, three false passports, four years of fighting, at least 11 court actions - and the battle between two bitter parents is far from over.

The South African woman who snatched her son from her ex-husband and fled to South Africa has now lost custody of her son in the US and faces an attempt to extradite her.

On Thursday, more papers were filed in the Pretoria High Court in the battle for custody over Liam Berger, four, the US-born child snatched by Linda Volschenk Berger in October and taken halfway around the world on a false passport.

The papers indicate that Hal Berger, Liam's father, won an emergency order from the California courts for sole legal and physical custody of Liam on October 12, two days after Linda failed to return Liam to his father after a visit and disappeared with him.

The same court order bars Linda from any contact with Liam and orders her to return the boy to his father.

Eleven days later, the California court issued a "felony complaint for extradition" against Linda for disappearing with Liam.

The court action is one of two under way in the Pretoria High Court between the warring parents and the South African authorities acting with powers conferred by an international treaty on child abductions.

The first case was brought by Linda in early November against the SA Central Authority and Hal. In this case, Linda won an interim order allowing her to stay in SA, have custody of Liam and blocked Hal's access to the boy.

This case backfired on Linda when she was forced to admit she had used false passports to leave the US, travel through various countries and arrive in SA. In December, she has to explain to the court why she should not be arrested for failing to provide the documents.

The second was brought by the Central Authority and Hal against Linda to demand Liam's return to the US.

Hal's lengthy affidavit, filed in both cases, details the protracted fight over Liam's custody, court battles, arrest warrants, fights at international airports, and squabbles over cars he paid for Linda to use in the US.

In an affidavit to the Pretoria High Court, Linda said her situation in the US was intolerable.

Earlier, Linda's mother told The Star she was concerned that Hal was abusing Liam.

In his affidavit filed in the Pretoria High Court on Thursday, Hal said Linda told the California court in April that "Hal is a good parent" and that it was best for Liam to stay in the US.

I'm so glad that these mother don't run with the kids. I wonder what will happen to her once she is back. I bet she will be let off easy. We all know if this was daddy, he will be in jail for years.

murdered toddler's father speaks out

EL PASO, TX - The biological father of the three-year-old girl found beaten and stashed away in the trunk of a car says her mother and stepfather are to blame.

21-year-old Marco Gonzales says his worst nightmare come true. He tells ABC-7 he had not seen his daughter , Jacqueline Gonzales, for several months because of an on-going custody dispute with her mother, Yara Perez.

Perez and her common-law husband Franscisco Castaneda were arrested and charged in the toddler's death.

Gonzales says the news of his daughter's death has him and his family devastated and now they want answers.

According to him, the last few times they saw the toddler, she showed clear signs of abuse. The alleged abuse was reported to Child Protective Services but nothing was done, he says.

He is convinced Perez and Castaneda are responsible for the death. "They did it. They both have something to do with it. Now, I don't want to go to court for them to plead insanity. They are not insane, they're just sick," he said.

Gonzales says he and Perez were due back in court next January for another hearing related to the on-going custody battle for the toddler.

"I hope (they) go through what Jacqueline went through, you guys will pay for this. Justice will be served," he says, in regards to Perez and Castaneda.

OMAHA, Neb. (AP) — A schoolteacher accused of having sex with a 13-year-old male former student wants custody of her 8-year-old daughter to go to her parents, not the child's father, her lawyer said Wednesday.
A hearing is set for Dec. 5 to determine temporary custody for the daughter of Kelsey Peterson, who is facing federal and state criminal charges for fleeing with the former student to Mexico.
A judge last week granted emergency legal custody of the girl to the child's father, William Alexander Long of Texas. The girl had been staying with Peterson's parents in Gothenburg, Neb.
Peterson gave birth when she was a high school junior. Long was Peterson's boyfriend and classmate. Long and Peterson never wed and broke up in 2001, according to court documents.
"There's not that much contact, (the daughter is) not comfortable with him," Peterson's lawyer James Martin Davis said. "She saw a therapist and said she doesn't want to go to Texas. She cries because she has to go with them."
A telephone message left for Long's lawyer, Robert Parker, was not immediately returned Wednesday.
Long has said he was seeking custody of his daughter because he feared that she could suffer irreparable harm as a result of Peterson's actions, according to court documents.
Long said that he was in the investment business and that he has been married for five months. The couple lives in McKinney, a Dallas suburb.
Davis is not representing Peterson in the custody case, but said he spoke to her by phone about the case on Wednesday.
Peterson, 25, and the male former student of hers were found in Mexicali, Mexico, on Nov. 2. The boy has told The Associated Press that he didn't consider Peterson his girlfriend but that they did have sex.
Peterson faces federal charges of crossing a border to have sex with a minor and state charges of kidnapping, child abuse and contributing to the delinquency of a minor.
The Associated Press had previously named the boy as police searched for him but stopped using his name in reports after authorities charged Peterson with a sex crime.

However items to find interesting, child doesn't like father, doesn't want to move, child see a therapist.

In this case the judge gets its right.

A Father Fears His Wife Is Turning The Kids Against Him

DEAR DR. SCANTLING: I'm desperate. I'm afraid that my soon-to-be-ex is turning my kids against me and making them think I don't love them. We're in the middle of a nasty custody battle, and I know that it would be better for the kids if they lived with me.

My daughter is 9, and my son is 11. My wife has a new boyfriend who has already moved into the house that I built! Her new lover is taking my kids to their sports events, and the kids ignore me when I'm there. Whenever I call, she makes some excuse for the kids not to come to the phone. ... They're in the tub, or watching TV, or asleep. I'm worried that they're being brainwashed against me. I've read about the Parental Alienation Syndrome, and I think it may be going on. Do you know anything about it? I have a lawyer and a therapist, but I'm getting different advice from both of them. I want what is best for my kids, but I don't want to lose them!

DEAR MICHAEL: I'm not a specialist in treating children, but I frequently work with partners involved in custody "battles," aptly labeled because they become a mess for everyone involved - especially the children who are caught in the line of fire.

Parental Alienation Syndrome, or PAS, was coined by Dr. Richard Gardner more than two decades ago, as a cluster of symptoms seen in children going through custody disputes who reject one parent because of strong negative claims made by the other parent.

There are questions whether parental alienation is an actual "syndrome" in the formal medical sense, but there is no question that alienation exists from mild to severe. There are multiple causes for claims of PAS, including "brainwashing" by the aligned parent or because the rejected parent needs someone to blame for their poor relationship with their children.

Shifts in parent-child alignments are common during custody litigation. Whether this requires professional intervention depends upon a variety of factors, including the degree of maturity of the children, the solidity of the pre-divorce attachment to the parents and the degree of animosity between the warring couple.

Children struggle to make sense of the senseless. Parents, who once loved each other, now hate each other. "How can this be?" they wonder. They long to trust what they are told by their mom or dad, but are confused and frightened when stories conflict. Step-siblings, extended families, and new love interests may all take sides in the vilification process.

Parental denigration or disenfranchisement can be subtle or overt "Call me if there are any problems when you're with dad, honey" a parent may "harmlessly" instruct. Or there may be numerous calls during the other parent's visitation to "check" on them, suggesting they are in less than competent care. Parents may even accuse the other of abuse, when it is unfounded. Making disparaging remarks or encouraging your children to spy on the other parent is a set up for alienation. Asking a child to be the messenger or routinely pumping them for information about "what's going on at mommy or daddy's house" is unacceptable. These behaviors only serve to weaken a child's sense of safety, security and trust in their caretakers.

So don't rush to judgment, Michael. Not all children who show parental preference are the product of parental alienation. Any parent who has been in your shoes empathizes with your pain and anxiety. When a child "chooses" the other parent, it's hard not to feel deficient, humiliated and unloved. This wound is often expressed through rage and an even more determined embattled posture. It feels like you're literally fighting for your life.

In your case, and in all cases, before there is a determination of PAS, the entire family picture must be evaluated by a competent licensed professional you trust. If you don't feel comfortable with the legal or mental health professionals you have at this time, find another team. Professionals may become wedded to a particular viewpoint and unintentionally fuel alienation. Agendas drive perspective. In the midst of polarization and heated allegations, parties may focus on the "win" but when a child loses, no one wins.

We need the wisdom of King Solomon to let go when we love. Find the courage to give up the battle and win the bigger prize the health and happiness of your children. Tell your children that you are ending the legal fight because you love them. (It would be best if you could tell them this in the company of their mother). That you understand they love both of you. Tell them that you wish you could be with them more, but that it isn't possible right now. That you feel sad, but will stay involved in their lives. Invite them to call or write whenever they would like and that you will always be their dad and mom.

Maintaining parental communication is essential, but difficult in acrimonious highlyconflicted relationships. In your therapy sessions, set up protocols for sharing information in writing or in log books that "connect" households while respecting their separate boundaries. Specify parameters for what is to be communicated and what is not. Agree on methods to monitor compliance and achieve cooperative resolutions.

Children may remove themselves from the storm of controversy to stay afloat in a capsizing vessel by aligning with one parent. We need to believe that they are doing the best that they can, given their particular circumstances.

Parents are the responsible adults first, last and always. Parenting in the best interest of your children is having the wisdom to empower their choices as painful as that may be. But I can assure you of one thing if you have nurtured a loving pre-divorce connection with your children, it is the best "vaccination" against loss and the best insurance for their future well-being.

WACO, Texas — A former prison guard is accused of stuffing a full-term baby in the tank of a toilet after giving birth in a motel bathtub.

Khaliliha Baucom, 24, was arrested Tuesday on a charge of abuse of a corpse after her recent indictment, but she may be charged with capital murder, Marlin police detective Sgt. Michael Baker said. She was released from Falls County Jail on Wednesday after posting $2,500 bond.

Baker said Baucom, of Lott, gave birth by herself in a Marlin motel bathtub in April. Then she was taken by ambulance to a hospital after she complained of bleeding and stomach pain, Baker said.

She was airlifted to a Waco hospital for an emergency C-section, but when doctors discovered she had already given birth, they called the police, the Waco Tribune-Herald reported in its online edition Wednesday.

Marlin officers found the baby's body in the toilet tank along with the placenta and bloody towels used to clean up the bathtub, Baker said.

Child Protective Services initially took custody of Baucom's three children, but they have since been living with their fathers, Baker said.

I see another great bias case in Texas, Mother kills child and get a $2500. pr bond, where if it was daddy or any man for that fact the bond would have been 10 to 30 times higher, are no bond at all.

TAUNTON, Mass. - A Taunton woman was arrested Tuesday after stabbing her two children and her mother.

Taunton police said 39-year-old Sandra Meninno was charged with assault with intent to murder and three counts of assault and battery with a knife.

The two children, ages 10 and 12, and Meninno's 64-year-old mother, were all treated for minor stab wounds and later released from a local hospital.

Police said Meninno had a history of mental illness.

Investigators said Meninno's mother was struggling with her daughter when police arrived at Mennino's Pond View Circle home at about 5 a.m.

Police said it was a good thing Mennino’s mother was there or it could have been a more tragic situation.

"She intervened and was holding her down when police arrived," said Chief Raymond O’Berg of the Taunton Police Department. "The mother is showing no remorse. We think that with the mental illness, she doesn’t have the capability to understand that she tried to kill her own children."

A neighbor told NBC 10 that the children often play in the neighborhood with the other kids, and that they are nice and happy kids.

"She loves those kids more than she loves herself," said Jeanette Meninno, Sandra's Meninno's grandmother. "She wasn’t aware of what was going on. She would have never done something like that to her kids."

The two children are now in their father's custody.

Authorities said the couple is in the process of divorcing, and that the father was not living in the home at the time of the incident.

Sandra Meninno, who did not appear at a hearing on Tuesday, was ordered by a judge to undergo a psychiatric evaluation.

She was ordered held without bail.

Shocking that the local DCF allow the father to have custody of the kids, since if they take the kids they get more money to work with.

Florida woman charged after putting baby in the oven

A Florida woman has been charged with aggravated assault after putting her baby in the oven and turning the appliance on. Sharlyn Singh allegedly put her 11-month old child in a heated oven after breaking up with the baby’s father.

A man was helping the baby’s father move out of the apartment when he heard the child crying. When he questioned Singh she fled the apartment. The man found the baby in the oven and called authorities. Police found Signh still in the apartment complex and she denied ever putting her child in the heated oven.

“The oven wasn’t terribly hot, but it was on,” said a police spokeswoman. The baby was not seriously hurt and was placed in custody of the Department of Children and Families.

My question is why didn't the DCF give custody to the father? I can only guess they blame him in same way. Then again FL DCF doesn't want fathers have custody at all.They will do just about anything to keep fathers away from their kids.

An Australian fathers' rights group believes paternity testing should be compulsory when a child is born.

An Australian DNA testing firm has found a quarter of all men who submitted tests were found not to be the child's biological father.

The Sun-Herald reported that the number of paternity tests taken in Australia had doubled from 3000 in 2003 to more than 6000 last year. click here to read more.

i completely agree, but I know that our so-called privacy groups here in the us would said no way. that it would created a new data base for id. in this time where identity theft is on the rise, maybe we should link our DNA to our SSN. That way we know who is who for sure. I would said this data base should be able to be use to see who did what crime in the past. That this data base is only for ID protection and paternity, only.

Then again we know that our Government can't be trusted to to keep it that way, in fact I guess its a bad ideal after all.

An unusual 'Safe Haven' situation

LAKE WALES - Thursday morning, firefighters in Lake Wales took in a baby boy given up by his mother under the Safe Haven laws.

Thursday night, the baby's father came to the station, frantic, wanting the baby back.

Firefighters and police say they had no idea what to do at first.

"Neither one of us had ever heard of this before," said Lake Wales Police detective Lynette Townsel. "We didn't know the protocol for it -- we'll be honest, we didn't know how to handle it at first."

Through emergency phone calls to the creator of the Safe Haven program and the Department of Children and Families, they learned the boy must stay with state workers who have custody now.

Adoption attorney Jeanne Trudeau Tate said that once a parent has given up a child, they have to go through a judge to get him back.

"The question is, does [the father] have a right to step forth? Yes. Does that mean he automatically gets the child back? No. The court still has to determine it's in the child's best interest and that his actions have not created a situation where his parental rights should be terminated," Tate said.

In the meantime, Lake Wales Police Officers said they felt the "Safe Haven" system worked correctly in this case, because no matter what happens to the baby boy in the weeks to come, he is safe, which is the first priority.

The question is, will he be able to get custody of the child, and if so will the mother be force to pay support?

Ex-girlfriend's lawyer: Dail should pay support

A Goldsboro attorney says even though Dwayne Allen Dail was wrongfully imprisoned, he is still obligated to pay for his child.

But the attorney representing Dail says state law holds that jailed mothers and fathers aren't subject to back child support payments.

Goldsboro attorney Sarah L. Heekin is representing Goldsboro resident Lorraine Michaels, the mother of Dail's biological son.

Dail was exonerated in August by a Wayne County Superior Court judge after spending 18 years in prison for a rape DNA evidence showed he did not commit.

Now that Gov. Mike Easley has pardoned him, Dail might be entitled to $20,000 per year for every year he spent behind bars, adding up to $360,000.

Ms. Heekin said she was limiting all comment on the case to one written statement:

"Prior to his incarceration Mr. Dail and Ms. Michaels were in a long-term relationship. After Mr. Dail's conviction and incarceration, Ms. Michaels gave birth to their biological son. For the whole 18-plus years of Mr. Dail's imprisonment, Ms. Michaels was a single parent and the sole means of financial support for their minor son. As most people are now aware, Mr. Dail's sentence was life imprisonment and thus no action for child support was ever filed.

"Since his release, Mr. Dail has not indicated any intention to provide support to Ms. Michaels thus, in order to fully protect my client's statutory rights, it was necessary to file an action ... prior to the minor's 18th birthday," Ms. Heekin said in the statement.

But Goldsboro attorney Shelby Benton -- who represented Dail as a public defender at his late 1980s trial -- says state law doesn't encumber Dail with child support payments.

Mrs. Benton, who attended Dail's exoneration proceedings, is representing Dail again after telling the wrongfully convicted man and his son "if they needed anything, call me."

"We will be vehemently defending the action," Mrs. Benton said. "The state says if a person is incarcerated, child support abates."

A look at N.C. Statute 50-13.10 seems to support Mrs. Benton's statement.

No "arrearage" -- fancy lingo for the state of being behind in payments -- can build up when a person is in prison, the law states.

"A child support payment or the relevant portion thereof is not past due and no arrearage accrues ... during any period when the supporting party is incarcerated, is not on work release, and has no resources with which to make the payment," the law states.

Other exceptions to child support arrearage are after the supported child's death, death of the supporting parent, or when the child lives with the supporter because of a court order.

Another exception is "an express or implied written or oral agreement transferring primary custody to the supporting party."

Man who was deceived about paternity retains custody

The Kentucky Supreme Court has ruled that people who deceive their spouses into thinking that a child is theirs cannot later contest their right to custody -- even if DNA tests show they are not the parent.

The court unanimously upheld a lower court ruling granting primary custody to Ren Ricky Hinshaw, whose wife led him to believe he was the father of their child until they divorced and she produced genetic testing showing the child wasn't his.

In an opinion issued Thursday, the court said that the "acts, language and silence" of Hinshaw's ex-wife, Jacqueline Lenarz, "were aimed at misleading Ren into believing he was Asher's biological father." The court also said that while they were married, she intended for him and the child to develop a strong father-son relationship.

The Courier-Journal outlined the case in a March 18, 2007, story about how courts are grappling with vexing questions about what makes a father a father -- whether it is the man who contributed the sperm or the one who changed a child's diapers, taught her how to ride a bike and took her to soccer practice.

The story described how Hinshaw, then 58, was fighting to retain joint custody of a child he helped raise and loves as his own, even after finding out the boy was not his biological child.

"He is my son, and I am his dad," Hinshaw said at the time.

Hinshaw's lawyer, Stephen Imhoff, said his client, who has had primary custody of the child pending the ruling, is pleased.

"It's been a long haul, and he is extremely happy," Imhoff said.

Lenarz's lawyer, Peter Ostermiller, said she was disappointed and that they are reviewing whether there are grounds for an appeal in federal court.

The Supreme Court, in an opinion written by Justice Bill Cunningham, described how Hinshaw was in the delivery room when the boy he thought was his son was born in 1999.

Hinshaw, a technology consultant at the University of Louisville's Kornhauser Health Sciences Library, cut the umbilical cord and later taught the boy to talk and volunteered at his school, according to court records.

But when Lenarz, also a librarian, divorced Hinshaw in 2003, she disclosed he wasn't the biological father and asked Jefferson Family Court to deny him custody, citing DNA tests which showed he couldn't be the father.

A court-appointed psychologist who met with the child concluded he had bonded with Hinshaw and that severing the relationship would cause the boy "severe emotional and psychological harm," the Supreme Court noted.

It also said that a family court judge, awarding principal custody to Hinshaw, said that his wife had "always represented, both to Ren and the world," that he was the child's father.

The Court of Appeals last year affirmed the decision, but Lenarz appealed.

The Supreme Court said that if Hinshaw had known that he wasn't the father when the child was born, he could have tried to adopt him.

Mom pleads guilty in infant son's death

A 31-year-old mother from Windsor has pleaded guilty in the death of her two-year-old son. Tammie Steinhoff pleaded guilty to manslaughter during a pre-trial hearing Thursday and sentencing is set for Dec. 21.

In June of last year Steinhoff was seen carrying the body of her son River along a road in the city.

Police allege the woman threw him to the ground in the middle of a busy thoroughfare and ran off.

An autopsy found he died of stab wounds.

Police say when an officer gave chase and apprehended the woman, she flailed at him with a knife, stabbing him twice in the arm and back

This came for an email list that I'm on, she pleaded guilty to manslaughter, how nice. Now I sit and wonder what if? Yes, what if? If this was a father who has done what she had would he get to plead to manslaughter charge, I think NOT. We know that there are two types of justice and sentencing for men and women, i.e. fathers and mothers. It would seem that women get off easier than men do. This is neither right nor fair.

Father are today in this country nothing more than ATM and throw aways. There are to be blame for all the ills of the world.

This movement is a "backlash" against government corruption, the organized and intentional destruction of the institution of family, and 10s of billions of dollars being stolen from government coffers as well as from fathers and children; organized crime. Even those who still do not understand the connection between the battle for fathers' rights and their own lives may eventually want to know where their money is and whether they can get it back. They will certainly not want to continue paying extra taxes merely to support criminal gangs.
